IRS Procedures for Requesting Public Inspection of Forms 990-T

The IRS released an advance copy of Announcement 2008-21 which explains the procedures for members of the public to make requests of the IRS for inspecting and copying a section 501(c)(3) organization’s annual return that reports unrelated business income on Form 990-T.

The IRS stated that requests for public inspection are to be filed on Form 4506-A, Request for Public Inspection or Copy of Exempt or Political Organization IRS Form. While Form 4506-A currently does not have a check box for this request, parties can use line 7 and write in “Form 990-T” to request to inspect or copy a Form 990-T filed after August 17, 2006.

Background

The Tax Technical Corrections Act of 2007 (Pub. L. 110-172) included a mandate that the IRS must make Forms 990-T that are filed by a section 501(c)(3) organization publicly available for inspection and copying. The effective date of this provision is for returns filed after August 17, 2006 (the date of enactment of the Pension Protection Act of 2006).

Announcement 2008-21 will appear in Internal Revenue Bulletin 2008-13, dated March 31, 2008.
